These terms of use govern your access to and use of the website at atbmalta.com(the “Site”), provided by Autobahn Limited (trading as Autobahn Malta) (“we”, “us”). By using the Site, you agree to these terms. If you do not agree, please do not use the Site.
Buying or leasing a vehicle, insurance, and other services may be subject to separate written contracts, quotations, and disclosures (for example, finance, leasing, or part-exchange). Those documents prevail over anything on the Site if there is a conflict.
1. Information on the Site
We aim to keep vehicle descriptions, prices, images, and availability accurate and up to date. The Site is for general information. Errors, technical delays, or display issues may occur. A vehicle remains available only until it is sold or reserved under our then-current procedures. Nothing on the Site is an offer that we must accept at that price or specification; it is an invitation to make an enquiry or visit us.
2. No warranty
The Site, its content, and any tools are provided on an “as is” and “as available” basis. To the fullest extent permitted by law, we exclude warranties of any kind, whether express or implied, including (without limitation) as to fitness for a particular purpose, accuracy, or non-infringement, except that nothing in these terms limits rights that cannot lawfully be limited under applicable Maltese or EU consumer or other mandatory law.
3. Limitation of liability
To the maximum extent permitted by law, we are not liable for any indirect, consequential, or special loss, or for loss of profit, data, or business, arising from or in connection with your use of the Site or reliance on its content. Our total liability for all claims relating to the Site in any 12-month period, where we are at fault, is limited to €100 or the amount (if any) you paid us for access to a paid part of the Site, whichever is higher — except that this cap does not apply to liability for death or personal injury caused by negligence, fraud, or any other liability that cannot be limited under law.
4. Acceptable use
You agree not to misuse the Site, including by: attempting to gain unauthorised access; introducing malware; scraping, harvesting, or automating access in a way that unreasonably burdens the Site; impersonating another person; or using the Site in violation of any law. We may suspend or block access if we reasonably believe a breach has occurred.

Text, images, branding, design, and software on the Site are either owned by or licensed to us. You may view and print pages for personal, non-commercial use. You may not copy, republish, sell, or exploit our content for commercial purposes without our prior written consent, except for sharing links to our pages in a normal way.

These terms are governed by the laws of Malta(excluding conflict-of-law rules that would send a dispute to another state's law). The courts of Malta have exclusive jurisdiction over any dispute relating to the Site, subject to any mandatory rights you have as a consumer under the laws of the country in which you reside, where applicable.
